Terms of Service

1. Scope of service

Foundation Health is a health technology platform that provides health intelligence and risk assessment tools. Foundation Health is not a medical provider and does not provide medical diagnosis, treatment, or emergency services.

2. Informational use only

Reports, scores, and recommendations generated by Foundation Health, including AI-generated outputs, are for educational and informational purposes only. They are not medical advice and are not a substitute for care from a licensed healthcare professional.

3. Clinical decisions and professional care

You are responsible for decisions you make based on platform content. Always consult a qualified clinician for diagnosis, treatment planning, medication decisions, and urgent or serious symptoms.

4. Biomarker testing and third-party labs

When biomarker testing is available, specimen collection and laboratory analysis are performed by independent third-party, CLIA-certified laboratories. Foundation Health does not perform laboratory testing and does not practice medicine.

5. Eligibility and accounts

You must be at least 18 years old to use the service. You are responsible for maintaining the confidentiality of your account credentials and for the accuracy of information you submit.

6. Data ownership and platform rights

You retain rights to your personal data, subject to the licenses and permissions needed for Foundation Health to operate the service. We may use de-identified and aggregated information to improve product quality, analytics, and model performance.

7. Acceptable use

You agree not to misuse the platform, attempt unauthorized access, interfere with service operations, submit harmful code, impersonate others, or use the service for unlawful purposes.

8. Intellectual property

Foundation Health, including its software, design, content, and trademarks, is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works.

9. Limitation of liability

To the fullest extent permitted by law, Foundation Health and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the service.

10. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted availability.

11. Dispute resolution

If a dispute arises, the parties will first attempt to resolve it informally. If unresolved, disputes will be resolved in accordance with applicable law and the venue requirements below.

12. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any legal action shall be brought in the state or federal courts located in Delaware, unless otherwise required by applicable law.

13. Changes to these terms

We may update these Terms periodically. If we make material changes, we will post the updated Terms with a revised effective date. Continued use of the service after updates means you accept the revised Terms.
